4. SMS AND TEXT MESSAGING COMMUNICATIONS

A. Program Description & Consent

Cancinos Insurance Agency offers mobile text messaging services to communicate with clients and prospects regarding policy updates, insurance quotes, claims processing, billing/payment reminders, and general customer service inquiries. By providing your mobile telephone number and opting in via our website forms, text message initiation, or explicit written consent, you authorize Cancinos Insurance Agency to send text messages (including SMS and MMS) to your phone number.

  • No Conditional Consent: Consenting to receive text messages is completely voluntary and is not a condition of purchasing any insurance policy, product, or service from us.
  • Frequency: Message frequency varies based on your specific insurance transactions, claims status, and interactions with our agency.
B. Opt-Out & Stop

You can cancel the SMS service at any time. To stop receiving text messages from Cancinos Insurance Agency, reply "STOP" to any text message we send you. After you send the message "STOP", we will send you a final confirmation SMS message to verify that you have been unsubscribed. Following that confirmation, you will no longer receive text messages from us unless you explicitly opt back in.

D. Carrier Rates and Liability
  • Message and Data Rates: Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, please contact your wireless provider.
  • Delivery: T-Mobile, AT&T, Verizon, and other mobile carriers are not liable for delayed or undelivered messages.
E. Mobile Privacy Policy Addendum

We deeply respect your privacy. Mobile information, phone numbers, and opt-in consent collected specifically for SMS purposes will not be shared, sold, or rented to third parties or affiliates for marketing or promotional purposes.

5. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:

  • Systematically retrieve data or other content from the Services to create or compile a database or directory without written permission from us.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR LOSS OF DATA ARISING FROM YOUR USE OF THE SERVICES.

7. GOVERNING LAW

These Legal Terms shall be governed by and defined following the laws of the Commonwealth of Massachusetts. You irrevocably consent that the state and federal courts of Massachusetts shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.
